Our Commitment to Privacy
At Viocare, protecting your privacy is important to us. We understand you may have questions or concerns regarding your personal information and how it will be used. With this in mind, we have developed this Privacy and Content Use Policy. Please note that all capitalized terms not defined herein shall have the meaning ascribed to them in the User Subscription Agreement between you and Viocare.
Applicability of Privacy and Content Use Policy
This Policy applies to the Content, including User Data, you upload, post, email, transmit or otherwise make available via the Programs and Services, as well as, any Content of Viocare, users, subscribers, and other third parties you download, access, or otherwise receive via the Programs and Services.
Content We Collect and How It May Be Used
On some Programs and Services, you may be able to submit queries, download information, respond to questionnaires, or request services. The types of Content we collect when you access the Programs and Services may include, without limitation, the following:
- User Data, such as:
- Your Name
- Your Gender
- Your Address
- Your Electronic Mail (“Email”) Address
- Your Phone/Fax Number
- Activity
- Diet
- Credit Card and Billing Information (If you purchase Programs or Services directly)
- Other Content, such as:
- IP Address
- Queries
- Bulletin Board Postings
- Forum Discussions
- Blog Messages
- Chat Conversations
- Email Communications
- Other transmissions
Some of the Content we collect via the Programs and Services is gathered and maintained through the use of “cookies” and other methods. A “cookie” is a small file that is saved on your computer and that contains information about you, such as your user name and password. As a result, we are able to (a) recognize you when you access the Program or Service, so that you do not have to re-enter your personal or other information each time you visit the Program or Service, (b) customize and personalize the Content we make available to you, (c) maintain the “state” of your current visit, and (d) alert you to new features.
In addition, we may collect certain non-personal data in connection with the Programs and Services. For example, we may collect information on the browser that you use to access the Program or Service, the operating system that you are running, what items you clicked on the applicable web page, how long you viewed a certain page, and information about the web site you accessed immediately before you accessed the Program or Service. We may aggregate your non-personal data with the non-personal data of our other users or other non-personal data collected offline. We also collect and analyze general traffic patterns within our Programs or Services to help maintain the flow and Content, and we may use some or all of this information to support our commercial activities or for any other reason.
We may from time to time send information and/or offers to the email address you provide to us. If you prefer not to receive such email, please follow the procedures set forth at the end of each such email explaining how to have your email address “removed” from the applicable email list. Alternatively, you may contact us to “opt-out” of receiving such email.
Your Content (including User Data) is used by us and by others on our behalf to provide you with our Programs and Services. Unless we tell you otherwise, any companies that work on our behalf to provide a Program or Service do not have any right to use the Content we provide to them beyond what is necessary to assist us. Your Content (including User Data) is also made available to a Subscriber who has purchased Programs and Services on your behalf. Please note that any restrictions on use of such Content (including User Data) are not part of this privacy policy or your User Agreement. Accordingly, we suggest you contact the Subscriber directly for this.
Except as specified in this Privacy Policy or as otherwise authorized by you, we will not disclose your personally identifiable information to any third party, unless required to do so by law; provided, however that we may (a) use such information to support our customer satisfaction initiatives, (b) from time to time disclose such information to selected third parties offering products or services in which you may be interested, and (c) disclose such information to other companies provided that such third party agrees to comply with the provisions of our Policy with respect to the use of your Content.
In addition, we may give you the ability to connect and communicate with users, subscribers, and other third parties through various sharing features in the Programs and Services, including chat conversations, blog messages, bulletin board postings, email communications, and similar transmissions. Any Content you provide through these means is done on a voluntary basis, and is entirely at your choice whether to do so. As such, you need to ensure that you have the rights to share the Content with such parties. Further, please understand that once you do, such parties have the right to use such Content, with or without your knowledge of such use. Accordingly, please do not provide any proprietary or confidential information (including health information) about you or anyone else via such means.
Content We Make Available and How It May Be Used
Viocare provides various Content through the Programs and Services for your personal use as an information resource. Such Content is protected by copyright and may not be copied or distributed to anyone else without Viocare’s prior written consent, except you are permitted to share such Content with your doctor, dietitian or other health care professional.
Viocare partners with organizations that wish to license Viocare Content for commercial use (i.e., display on their websites or other communications). For more information about Content licensing and partnership opportunities, please contact info@viocare.com
In addition, you may use any Content you receive from users, subscribers, and other third parties through various sharing features in the Programs and Services. It is your responsibility to investigate, identify and differentiate Viocare Content from that of users, subscribers, and other third parties.
Information From Children
Under the Children's Online Privacy Protection Act ("COPPA"), no website operator can require, as a condition to participation in an activity, that a child younger than 13 years of age disclose more personally identifiable information than is reasonably necessary. Viocare complies with this requirement and only collects such information from children under 14 that is voluntarily provided and to which that the child's parent/legal guardian has assented.
Although children under 14 may be allowed to participate in some Programs and Services, they must provide a parent or legal guardian's email address. We send the parent/legal guardian an email when their child subscribes to a particular Program or Service, or is so authorized by a Subscriber. We provide the parent/legal guardian forty-eight (48) hours to refuse their child's subscription. If the parent/legal guardian refuses to allow the child's subscription, we delete the child's information from our database. If we do not hear back from the parent/legal guardian within such time frame, we assume it is acceptable for the child to be subscribed to the Program or Service. Once a parent/legal guardian permits a child to subscribe, the child will be able to continue any such Program or Service without further notification to the parent/legal guardian until such time as the parent/legal guardian revokes such registration or the child turns 14 years of age.
Our Commitment to Data Security
We strive to prevent unauthorized access to your personally identifiable information, maintain data accuracy, and ensure the correct use of such information. Accordingly, we have put in place physical, electronic, and managerial procedures to attempt to safeguard and secure the Content we collect. However, no safeguards or security procedures are completely effective. We urge you to take all reasonable precautions to protect your personal data, which should include never sharing your username and password with anyone.
Occasionally, in a scam known as "phishing," mass emailers will send messages that claim to be from Viocare, or one of our Programs or Services. They may use our name, logo, or employee email addresses in fraudulent emails trying to obtain valuable information from consumers and businesses. These con artists know that people trust Viocare. That is why they may use our name to trick you into believing that they are dealing with a legitimate request for personal information. These fraudulent emails often create a false sense of urgency intended to prompt the recipient to take action. We urge you to take all reasonable precautions to confirm that any emails your receive are legitimate, so as to protect your personal data.
How to Access or Correct Your Content
You can access your personally identifiable information that we have collected and that we still maintain by contacting us as described below in “How to Contact Us.” You can correct factual errors in your personally identifiable information by sending us a request that credibly shows that our records are incorrect, although we may refuse such requests in our sole discretion. To protect your privacy and security, we may also take steps to verify your identity before granting access to your personally identifiable information or permitting you to make corrections.
Changes to Our Policy
We reserve the right to revise this Privacy and Content Use Policy from time to time in our discretion. If we modify this Policy, we will post the revised Policy at http://www.viocare.com/Legal/PrivacyPolicy.aspx, which will take effect immediately upon posting, and we may attempt to notify you of such change through your email addresses registered with us. It is your responsibility to periodically review this Policy.
